What a Personal Injury Claim Can Recover

California law recognizes three categories of damages in a personal injury case. Insurance adjusters are trained to minimize the second one, which is often the largest part of a serious claim.

Economic Damages

The measurable losses: emergency and ongoing medical treatment, surgery, physical therapy, prescriptions, assistive equipment, lost wages, lost earning capacity, property damage and out-of-pocket costs.

Non-Economic Damages

Physical pain, emotional distress, anxiety, disfigurement, loss of enjoyment of life and the strain an injury puts on your relationships. California places no cap on these damages in ordinary injury cases.

Punitive Damages

Available in a narrow set of cases, such as a drunk driver or conduct showing a conscious disregard for safety. These are meant to punish the wrongdoer rather than compensate you.

California Deadlines & Rules You Need to Know

Personal injury claims in California run on hard deadlines. Two of them end cases before anyone ever looks at the merits, and the shortest one catches people who were hurt on public property.

Two years to file most injury claims

California Code of Civil Procedure section 335.1 gives you two years from the date of injury to file a personal injury lawsuit. Miss it and the claim is generally barred, no matter how strong it was.

Six months for claims against a government entity

If the City of San Diego, the County, Caltrans, MTS or another public entity is involved, Government Code section 911.2 requires an administrative claim within six months. This is the deadline people miss most.

Being partly at fault does not end your case

California follows pure comparative negligence. If you are found 30% responsible, your recovery is reduced by 30% rather than eliminated. Insurers rely on you not knowing this.

Deadlines are extended for injured minors

When the injured person is under 18, the two-year clock generally does not begin to run until their 18th birthday. Other exceptions can apply, so do not assume a case is too old.

How much does a personal injury lawyer cost in San Diego?

Nothing up front. We handle personal injury cases on a contingency fee, which means our fee is a percentage of what we recover for you. If there is no recovery, you owe no attorney's fee. The exact percentage is set out in writing before you sign anything.

How long do I have to file a personal injury claim in California?

Generally two years from the date of the injury under Code of Civil Procedure section 335.1. If a government entity is involved, you must file an administrative claim within six months under Government Code section 911.2. Certain situations, including injuries to minors, extend these deadlines. Because these rules are unforgiving, have the dates reviewed early.

What is my personal injury case worth?

Any lawyer who quotes a number before reviewing your medical records is guessing. Value depends on the severity and permanence of the injury, total medical costs, lost income and earning capacity, the strength of the liability evidence and, critically, how much insurance coverage exists. We give you a realistic range once we can see the file.

What should I do right after a car accident in San Diego?

Call 911 and report the crash, get checked by a medical professional even if you feel fine, photograph the vehicles, the scene and your injuries, collect witness names and contact information, and notify your own insurer. Do not give a recorded statement to the other driver's insurance company, and do not sign a release, before you have spoken with an attorney.

The insurance company already offered me money. Do I still need a lawyer?

A fast offer usually arrives before anyone knows the full extent of your injuries, and accepting it closes the claim permanently. Have the offer reviewed before you accept. If it is fair, we will tell you so.

What if I was partly at fault for the accident?

You can still recover. California uses pure comparative negligence, so your compensation is reduced by your share of fault rather than eliminated. Adjusters often overstate a claimant's share of fault, which is one of the first things we push back on.

How long does a personal injury case take?

Straightforward claims can resolve in a few months once medical treatment is complete. Cases involving serious injuries, disputed liability or litigation commonly take a year or more. Settling before your treatment stabilizes is usually a mistake, because you cannot reopen the claim later.

Will my case have to go to trial?

Most personal injury cases settle. That said, cases settle for more when the other side believes the firm is willing and able to try them. We prepare every case as though it will be tried.

What if the driver who hit me had no insurance?

Your own uninsured or underinsured motorist coverage may apply, and there may be additional responsible parties, such as an employer if the driver was working. We look for every available source of coverage rather than stopping at the at-fault driver's policy.

Can I file a claim if I was hurt on public property?

Yes, but the rules are different and the clock is much shorter. Claims against the City of San Diego, the County, Caltrans, MTS or a school district generally require an administrative claim within six months of the injury. Contact an attorney immediately in these cases.
